Ostatn\u00e9 dve stavby u\u017e vy\u0161e 15 rokov dymom a pachom znepr\u00edjem\u0148uj\u00fa \u017eivot mojej rodine. V sez\u00f3ne zak\u00e1\u013ea\u010diek ide udiare\u0148 takmer nepretr\u017eite, preto\u017ee sused pon\u00faka svoje &#171;slu\u017eby&#187; ka\u017ed\u00e9mu, kto si o ne po\u017eiada. Pri svojej \u017eiadosti patri\u010dn\u00fdm kompetentn\u00fdm org\u00e1nom o odstr\u00e1nenie t\u00fdchto drobn\u00fdch a nepr\u00edjemn\u00fdch stavieb chcem dodr\u017ea\u0165 pr\u00e1vny postup. Ako by som mal v takomto pr\u00edpade postupova\u0165?<\/p>\n<p>Z\u00e1kon vlastn\u00edkovi veci v\u00fdslovne uklad\u00e1 povinnos\u0165 nad mieru primeran\u00fa pomerom neob\u0165a\u017eova\u0165 susedov hlukom, prachom, popol\u010dekom, plynmi, parami, pachmi, pevn\u00fdmi a tekut\u00fdmi odpadmi, svetlom, tienen\u00edm a vibr\u00e1ciami. Vlastn\u00edk pozemku teda nem\u00f4\u017ee vykon\u00e1va\u0165 \u010dinnosti, ktor\u00fdmi susedov obmedzuje vo v\u00fdkone vlastn\u00edckeho pr\u00e1va a znepr\u00edjem\u0148uje im chv\u00edle odpo\u010dinku, dokonca no\u010dn\u00e9ho pokoja.<\/p>\n<p>Stavby ako such\u00e9 WC, murovan\u00fd gril s kom\u00ednom, murovan\u00e1 udiare\u0148 s\u00fa drobn\u00fdmi stavbami v pr\u00edpade, \u017ee s\u00fa pevne spojen\u00e9 zo zemou alebo \u017ee sa na ich osadenie vy\u017eaduje \u00fapravu podkladu. Na v\u00fdstavbu tak\u00fdchto drobn\u00fdch stavieb je potrebn\u00e9 poda\u0165 ohl\u00e1senie drobnej stavby na stavebn\u00fd \u00farad, ktor\u00fdm je v s\u00fa\u010dasnosti mestsk\u00fd \u00farad, resp. obecn\u00fd \u00farad (spolo\u010dn\u00fd stavebn\u00fd \u00farad). Pri realiz\u00e1cii a umiestnen\u00ed drobnej stavby musia by\u0165 takisto ako pri be\u017enej stavbe dodr\u017ean\u00e9 v\u0161etky stavebnotechnick\u00e9 po\u017eiadavky aj vzh\u013eadom na po\u017eiadavky po\u017eiarnej ochrany alebo ochrany \u017eivotn\u00e9ho prostredia.<\/p>\n<p>O umiestnen\u00ed a v\u00fdstavbe drobn\u00fdch stavieb alebo o ich pr\u00edpadnom odstr\u00e1nen\u00ed je teda opr\u00e1vnen\u00fd rozhodova\u0165 stavebn\u00fd \u00farad, ktor\u00fd m\u00f4\u017ee vyzva\u0165 stavebn\u00edka aby tak\u00fato stavbu odstr\u00e1nil alebo aby dodato\u010dne ohl\u00e1sil stavbu.<\/p>\n<p>Stavebn\u00fd \u00farad mus\u00ed napr. aj na n\u00e1vrh presk\u00fama\u0165, \u010di umiestnenie stavby neohrozuje in\u00e9 nehnute\u013enosti alebo majetok a \u010di je v s\u00falade so z\u00e1konom a stavebnotechnick\u00fdmi normami.<\/p>\n<p>Ak niekto vykon\u00e1va s\u00fastavn\u00fa \u010dinnos\u0165 za \u00fa\u010delom dosiahnutia zisku a nem\u00e1 na tak\u00fdto v\u00fdkon vydan\u00e9 povolenie, napr. \u017eivnostensk\u00e9 opr\u00e1vnenie, m\u00f4\u017ee v takomto pr\u00edpade \u00eds\u0165 o neopr\u00e1vnen\u00e9 podnikanie, a to aj napriek tomu, \u017ee \u010dinnos\u0165 je vykon\u00e1van\u00e1 sez\u00f3nne. Org\u00e1n ktor\u00fd vykon\u00e1va \u017eivnostensk\u00fa kontrolu je \u017eivnostensk\u00fd \u00farad a tento je povinn\u00fd na z\u00e1klade podnetu kontrolu vykona\u0165.<\/p>\n<p>Okrem tohto postupu je mo\u017en\u00e9 sa obr\u00e1ti\u0165 na s\u00fad so \u017ealobou, v ktorej vlastn\u00edk pozemku ktor\u00fd je ob\u0165a\u017eovan\u00fd, po\u017eiada s\u00fad, aby prik\u00e1zal vlastn\u00edkovi susediaceho pozemku viac neob\u0165a\u017eova\u0165 susedov popol\u010dekom, pachmi, plynmi, parami.<\/p>\n<p><em>Trnavsko \u010d. 38, Pr\u00e1vna porad\u0148a, 26.09.2008<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Susedsk\u00e9 pr\u00e1va II.
