{"id":205,"date":"2016-07-05T14:40:08","date_gmt":"2016-07-05T14:40:08","guid":{"rendered":"http:\/\/michalicka.sk\/?page_id=205"},"modified":"2016-07-22T12:50:01","modified_gmt":"2016-07-22T12:50:01","slug":"prevod","status":"publish","type":"page","link":"https:\/\/www.michalicka.sk\/en\/advokatske-sluzby\/poradna-on-line\/prevod\/","title":{"rendered":"Prevod"},"content":{"rendered":"<h1>Ako postupova\u0165 pri prevode vlastn\u00edctva k nehnute\u013enosti?<\/h1>\n<p>Pred t\u00fdm ako sa pust\u00edte do prevodu vlastn\u00edckeho pr\u00e1va k nehnute\u013enosti V\u00e1m v kr\u00e1tkosti pop\u00ed\u0161eme postup ak\u00fdm sa tak\u00fdto prevod realizuje.<\/p>\n<p>Pred uzavret\u00edm riadnej zmluvy prev\u00e1dzaj\u00faci a nadob\u00fadate\u013e oby\u010dajne uzavr\u00fa zmluvu o bud\u00facej zmluve alebo podobn\u00fa zmluvu, v ktorej si dohodn\u00fa jednotliv\u00e9 podmienky prevodu (k\u00fapnu cenu, dobu do kedy sa riadna zmluva mus\u00ed uzavrie\u0165, do kedy sa prev\u00e1dzaj\u00faci z nehnute\u013enosti vys\u0165ahuje, kto bude plati\u0165 spr\u00e1vne poplatky). Uzavretie tejto zmluvy nie je podmienkou pre prevod vlastn\u00edckeho pr\u00e1va k nehnute\u013enosti. T\u00e1to zmluva ost\u00e1va v ruk\u00e1ch prev\u00e1dzaj\u00faceho a nadob\u00fadate\u013ea a neodovzd\u00e1va, neregistruje sa na \u017eiadnom \u00farade.<\/p>\n<p>Zmluvou o bud\u00facej zmluve sa fakticky a aj pr\u00e1vne zavia\u017eu obe zmluvn\u00e9 strany uzavrie\u0165 riadnu zmluvu. \u00da\u010delom zmluvy o bud\u00facej zmluve pod\u013ea \u00a750a Ob\u010d. z\u00e1k. je zabezpe\u010di\u0165 bud\u00face nadobudnutie vlastn\u00edctva k nehnute\u013enosti a splnenie podmienok zmluvy o bud\u00facej zmluve.<\/p>\n<p>Ak do dohodnutej doby ned\u00f4jde k uzavretiu riadnej zmluvy, mo\u017eno sa dom\u00e1ha\u0165 na s\u00fade do jedn\u00e9ho roka od kedy najnesk\u00f4r malo d\u00f4js\u0165 k uzavretiu riadnej zmluvy, aby vyhl\u00e1senie v\u00f4le jednej zo zmluvn\u00fdch str\u00e1n bolo nahraden\u00e9 s\u00fadnym rozhodnut\u00edm. To znamen\u00e1, \u017ee s\u00fad m\u00f4\u017ee rozhodn\u00fa\u0165 za prev\u00e1dzaj\u00faceho alebo nadob\u00fadate\u013ea, \u017ee doch\u00e1dza k uzavretiu zmluvy o prevode vlastn\u00edckeho pr\u00e1va k nehnute\u013enosti pod\u013ea ustanoven\u00ed dohodnut\u00fdch v zmluve o bud\u00facej zmluve (cena, vys\u0165ahovanie, poplatky).<\/p>\n<p>Ak d\u00f4jde k uzavretiu riadnej zmluvy prev\u00e1dzaj\u00faci ju mus\u00ed podp\u00edsa\u0165 \u00faradne overen\u00fdm podpisom u not\u00e1ra alebo na matrike (mestsk\u00fd alebo obecn\u00fd \u00farad). Nadob\u00fadate\u013e podpisuje zmluvu be\u017en\u00fdm podpisom. Samotn\u00fdm podpisom zmluvy o prevode vlastn\u00edckeho pr\u00e1va v\u0161ak v s\u00fa\u010dasnosti nedoch\u00e1dza k prevodu vlastn\u00edckeho pr\u00e1va. Je nevyhnutn\u00e9 poda\u0165 n\u00e1vrh na vklad na mieste pr\u00edslu\u0161n\u00fa Spr\u00e1vu katastra Katastr\u00e1lneho \u00faradu aby povolila a zap\u00edsala vklad vlastn\u00edckeho pr\u00e1va do katastra nehnute\u013enost\u00ed.<\/p>\n<p>K n\u00e1vrh na vklad je potrebn\u00e9 pripoji\u0165 zmluvu o prevode vlastn\u00edckeho pr\u00e1va k nehnute\u013enosti v po\u010dte vyhotoven\u00ed, ktor\u00fd zodpoved\u00e1 po\u010dtu \u00fa\u010dastn\u00edkov prevodu plus dve vyhotovenia.<\/p>\n<p>Je mo\u017en\u00e9 si vybra\u0165 medzi dvoma sp\u00f4sobmi vkladu vlastn\u00edctva. Je to be\u017en\u00fd vklad, ktor\u00fd trv\u00e1 pod\u013ea z\u00e1kona do 30 dn\u00ed, av\u0161ak praxou b\u00fdva, \u017ee Spr\u00e1va katastra pre mno\u017estvo n\u00e1vrhov nestihne vklad v tejto lehote vykona\u0165 (spr\u00e1vnym poplatok 2.000,-Sk). Druh\u00fd sp\u00f4sob vkladu je zr\u00fdchlen\u00fd vklad, ktor\u00fd trv\u00e1 do 15 dn\u00ed a v z\u00e1sade sa t\u00e1to lehota nepredl\u017euje, sk\u00f4r naopak (spr\u00e1vny poplatok 8.000,- Sk).
